Data Processing Definitions
"Anonymized" means data that has been stripped of personal identifiers and cannot reasonably be linked back to an individual, even with additional information or effort. Anonymized data is not considered personal data under applicable privacy laws.
"De-identified" means data where direct identifiers (such as name, email, or account ID) have been removed or masked, but re-identification could still be theoretically possible with significant effort or additional data sources. De-identified data may still be subject to certain privacy protections depending on jurisdiction.
We treat both anonymized and de-identified data as non-personal information under applicable law and use them for analytics, research, product development, and commercial purposes as described in this Privacy Policy and our Terms of Service.
5. International Transfers
If you are located outside the United States, your data may be transferred to and processed in the U.S. or other jurisdictions with different data protection laws.
Where required (e.g. under GDPR/UK GDPR), we rely on:
- Standard Contractual Clauses (SCCs)
- UK International Data Transfer Addendum (IDTA)
- Other appropriate safeguards
Data is primarily hosted in the United States.
If required, we implement additional safeguards for cross-border data transfers, per EU/UK data protection law.
6. AI Tools and Candidate Evaluations
Vibe Check uses AI models (such as OpenAI and others) to assist with code evaluation, scoring, and behavior analysis. By participating in questionnaires, assessments, quizzes, and other forms, you acknowledge that:
- AI interactions may be logged, stored, and reviewed by humans
- Misrepresenting AI-assisted content as human-authored may result in de-certification
- Some prompts may require disclosure of AI usage
- We use automated systems and AI-assisted scoring tools for candidate evaluations. Automated processing does not result in legal or similarly significant effects; final certification eligibility may incorporate human review.
Your AI usage during evaluations is part of your Evaluation Data.
6A. Future Use and Commercialization
We may use de-identified and anonymized user data (including resume data, employment history, behavioral signals, interaction logs, questionnaire and assessment results, and all other data types described in Section 2) to develop new products, analytics tools, research datasets, and services. These may include commercial offerings or business models that do not currently exist.
This includes, but is not limited to, developing behavioral models, employer matching algorithms, hiring risk tools, workplace analytics dashboards, or licensing datasets to research or enterprise partners. These uses are always consistent with the rights granted in our Terms of Service and applicable law.
We do not sell personal information as defined under applicable consumer privacy laws (such as CCPA/CPRA). However, we may commercialize anonymized, de-identified, or aggregated data as described in this section and in our Terms of Service.
